How to Prove Emotional Distress After A Truck Accident

Emotional Distress After A Truck Accident - Loading broken car on a tow truck on a roadside

Truck Accident Lawyer

Many people focus on the physical injuries from truck accidents. Although these injuries can result in serious physical injuries, like amputation and traumatic brain injuries, they can also cause severe emotional distress. If you have suffered emotional injuries from a truck crash, you may be entitled to compensation.

Types of Emotional Injuries in a Truck Accident

If you were involved in a truck accident, you may have suffered emotional distress. While psychological injuries might not be life-threatening, they are nothing to make like of. Here are the common types of emotional injuries in a truck accident.

  • Depression. A truck accident is a traumatic event and can cause depression in some victims. For example, if you sustained serious physical injuries, you might be out of work and can’t partake in activities you once enjoyed. This can make you feel sad and hopeless. You may isolate yourself from your family and friends and become a recluse. Others symptoms of depression include sleeping problems, poor appetite, apathy, fatigue and thoughts of suicide.
  • Anxiety. Some people may also experience anxiety after a truck accident. They may be too afraid to drive around trucks or even get in a vehicle at all. These victims may experience shortness of breath, chest pain, dizziness, trembling and difficulty concentrating. Having anxiety can be debilitating and make it difficult to go through everyday life.

Factors That Increase the Likelihood of Emotional Distress After a Truck Accident

Not everyone involved in a truck accident suffers emotional distress. Some people may go about their normal lives soon after a collision. Others, however, may not be so lucky. They may suffer emotional injuries that affect them for a long time. Here are a few factors that may increase the likelihood of emotional distress after a truck accident.

  • The victim suffered life-altering physical injuries, such as severe burns or amputation
  • The victim has experienced previous traumatic events
  • The victim is already dealing with a mental health disorder

How to Prove Emotional Distress

Proving physical injuries from a truck accident is pretty straightforward. Emotional distress, on the other hand, is a bit trickier to prove. However, it is not impossible. Generally, you will need to obtain testimony from a mental health professional who is currently treating you. If you have been prescribed medication for emotional distress, such as antidepressants, you will want to keep copies of your prescriptions.

In most cases, you can only obtain compensation for emotional distress if it has had a major impact on your life. For instance, if you were anxious and irritable for just a few days after a truck accident, you might not have a claim for emotional distress. However, if your emotional distress has lasted multiple months and has prevented you from working, you may be able to pursue compensation.
